In Swansea Stadium Management Company Ltd v. City & County of Swansea and Interserve Construction Ltd [2018] EWHC 2192, the court considered when a contract or deed can take effect retrospectively and when a cause of action arises. The TCC's finding that the parties' collateral warranty had retrospective effect meant the claimant's claim was issued out of time and statute barred.
