The deadline to obtain an Environmental License is approaching

In compliance with Governmental Agreement 137-2016 “Regulation of Environmental Evaluation, Control and Monitoring”, as of December 16, 2022, any project, work, industry, or any existing activity that due to its characteristics can deteriorate any natural resources must be regularized. Everyone must have an environmental license.

Activities that are already operating and do not have this license must apply for it and obtain the environmental approval resolution before the deadline of December 16.

In accordance with Decree 68-86 of the Environmental Protection and Improvement Law, companies or activities that do not have an environmental license after December 16 of this year will be sanctioned with a fine between of Q.5,000 and Q.100,000 (US$639.39 to US$12,787.72), depending on the category in which each project falls.

If your activity does not appear within the categories established by these regulations, it is necessary to go to the Environmental Management Directorate of the MARN to request its categorization, as this does not exempt you from the responsibility of having an environmental permit.
