The COVID-19 (coronavirus) pandemic has had an unprecedented impact on economic activity in the United States and globally, with businesses around the world experiencing slowdowns or shutdowns to prevent or slow disease transmission. These interruptions, whether voluntary or government-mandated, have given rise to claims from insureds for lost business income, and hundreds of lawsuits filed in federal and state courts. While any particular claim must be evaluated on its own facts and under the applicable policy terms, our program will discuss common legal issues that may be relevant to assessing coverage under Business Interruption provisions in commercial property insurance policies, including potentially relevant exclusions and coverage extensions. Discussion will also include litigation trends and analysis of court decisions that have been handed down in litigation seeking coverage for COVID-19 related losses under commercial property insurance policies.
