On April 23, the US Federal Trade Commission held a public hearing to formally adopt a new rule that will essentially ban all new noncompetes between employers and employees. The rule will also render most existing noncompetes unenforceable (except for certain “senior executives”). The FTC’s action is virtually certain to be subjected to intense litigation efforts before it fully goes into effect in about 120 days. What does this mean for employers?
