Over the past year, Québec courts have issued several important decisions that Canadian employers should be aware of.

Members of the Employment and Labour Law group in Montréal present 12 decisions rendered in 2022 by the Court of Appeal, the Superior Court of Québec, as well as by the Québec Administrative Labour Tribunal, and draw your attention to certain points to watch for in 2023.

The decisions included in the publication relate to various subjects, such as:

• The powers of the Administrative Labour Tribunal;
• The exclusive jurisdiction of the grievance arbitrator over allegations of defamation;
• The calculation of an indemnity in lieu of notice paid to an employee receiving disability insurance benefits at the time of their termination;
• The power of the civil courts to order the reinstatement of a former employee;
• The employer's access to the personal accounts of its employees,
• The interpretation of section 95 of an Act respecting labour standards;
• The limit of rebuttal evidence;
• Electronic monitoring in a telework context; and
• Vaccination against COVID-19.
