Practical to-do list for privacy and data security in 2023

We will discuss the practical steps that entities should take as we enter the new year to address the privacy and data security issues that are the focus of consumers, regulators, and plaintiffs’ attorneys. For each step, we will address the associated legal issues, including transparency, data and risk management, the use of artificial intelligence, the collection and use of biometric data, children’s privacy, consent and other bases for the right to collect and use data, and data protection obligations. Using real world examples, we will also discuss the consequences of inadequately addressing these issues and increasing the company’s risk profile, including investigations, consent decrees, fines, litigation, and reputational damage.
