Recently, Deputy Attorney General Lisa Monaco announced several significant changes to the Department of Justice’s (DOJ’s) corporate criminal enforcement policies coupled with a new advisory group that could recommend further changes. As the first major enforcement policy initiative during the Biden-Harris administration, it is anticipated to have a substantial impact on ongoing and future enforcement efforts. These changes will impact both proactive and responsive actions designed to address and mitigate legal risk generated by these policies in the United States and wherever DOJ investigations can reach.

This briefing discussed the impact of those changes, how they interact or conflict with the DOJ’s prior enforcement guidance, open questions about the policies and a look toward immediate steps and potential strategies that should be considered for responding to these new policies.
