Whether there is a so-called “fiduciary exception” to the attorneyclient privilege in Pennsylvania has been a hot topic for years, while there has been a statute on point in Florida. Recently, the Pennsylvania Supreme Court had an opportunity to look at this issue, but unfortunately it remains an unanswered question in Pennsylvania. This article focuses on the current differences between Florida and Pennsylvania as to the status of the fiduciary exception.
